Terms of Use

These proposed terms explain the use of Smart Butler by subscribers, staff, property owners and tenants. This draft is not yet effective and does not replace an existing subscription, tenancy or property-management agreement.

1. Platform operator and scope

Smart Butler is operated by Smart Butler Sdn Bhd, registration number 202501020174 (1621587-H). References to Smart Butler, we, us or our mean this company, not the subscriber whose name appears in a workspace.

Smart Butler provides property-operation tools, which may include property records, tenancy administration, documents, invoices, expenses, claims, owner and tenant portals, electricity top-ups, and supported meter or access integrations. Features depend on the subscription, user permissions and enabled integrations.

2. Subscribers, owners and tenants

A subscriber is the organisation administering a workspace. Its authorized staff manage records and access within that workspace. Owners and tenants receive access only to records made available to them through their assigned relationships and permissions.

Use of the platform alone does not make Smart Butler a party to a tenancy, appoint it as a property manager, or make it responsible for a subscriber's debts. Any separate property-management, payment or other service undertaken by Smart Butler must be governed by the applicable agreement. These proposed terms do not replace rental agreements or owner collaboration agreements.

3. Accounts and security

Provide accurate account information and use only accounts and invitations you are authorized to use. Keep passwords and verification codes confidential. Do not share an individual account to avoid access controls.

Tell us promptly if you suspect unauthorized access. Subscribers should assign appropriate staff permissions and remove access when a person no longer needs it. Access to a workspace does not authorize access to another subscriber's information.

4. Records, documents and personal information

Subscribers and users are responsible for the accuracy of information they submit and for having the necessary authority, notices and permissions to supply it. Upload only information and documents relevant to an authorized purpose, including information about occupants, emergency contacts or other people.

Owners, tenants and staff should report incorrect records to the responsible workspace administrator. Retain original evidence where appropriate; uploading a receipt or agreement does not by itself establish that a claim is approved, a payment has settled, or a document is legally valid. Personal-information handling is addressed separately in the Privacy Policy and applicable subscriber arrangements.

5. Subscriptions and service charges

Subscription features, fees, billing intervals and taxes should be set out in the applicable order, subscription agreement or checkout. Property rent, electricity charges, deposits and other subscriber charges are separate from Smart Butler subscription fees.

Renewal, cancellation, refund, trial and account-closure terms must be confirmed in the final subscription terms. This draft does not introduce an automatic-renewal arrangement, a cancellation deadline or a no-refund rule.

6. Property payments, top-ups and refunds

Property payments and electricity top-ups may be processed through the subscriber's configured payment gateway. Check the invoice, payee, amount, merchant details and checkout terms before paying. A redirect, screenshot or pending checkout is not confirmation that a payment has settled or electricity credit has been applied.

A meter's credit belongs to that meter; balances on different meters are not combined merely because a tenant rents more than one space. The applicable minimum top-up, tariff and payment status should be shown before payment. Provider connectivity can affect when a confirmed top-up reaches a meter.

Raise property-charge disputes and refund requests with the named payee or property manager, and report platform or payment-processing problems to Smart Butler support. The final policy must identify who authorizes and issues each type of refund, the applicable deadlines, and how failed, duplicated or unapplied payments are handled. Nothing in this draft declares all payments non-refundable.

7. Acceptable use

Do not misuse the platform or use it for an unlawful purpose.

  • Do not submit fabricated receipts, fraudulent claims, misleading payment evidence or documents you are not entitled to use.
  • Do not attempt to bypass permissions, compromise accounts, introduce malicious files or access another person's data without authorization.
  • Do not disclose another person's personal information outside the permitted purpose or use it for unauthorized marketing.
  • Do not interfere with payment callbacks, meter crediting, audit records or access-control integrations.

8. Availability and third-party services

Payments, email delivery, cloud storage, meter readings and smart-access functions can depend on third-party providers. Their applicable terms may apply to their services. Planned maintenance, network failures and provider interruptions can affect availability or delay updates.

Do not rely on an online status or a last-read balance as a guarantee of uninterrupted power or physical access. Contact the property manager for urgent property, electricity or access issues. Any promised service level or support response time must be stated in a separate confirmed service agreement.

9. Platform and submitted content

Smart Butler and its licensors retain their rights in the platform software, design and branding. Users retain their existing rights in submitted content; submitting content does not transfer ownership of it to Smart Butler.

The final subscriber agreement should authorize the processing of submitted content necessary to operate, secure and support the agreed service, while preserving confidentiality and data-protection obligations. It should also define authorized exports and access when the subscription ends.

10. Suspension, closure and records

Access may need to be restricted where required by law, to address a security threat, or under the applicable subscriber agreement. The final terms should explain notice, review, outstanding charges, and reasonable export arrangements, except where immediate restriction is necessary.

Closing a login account does not automatically erase issued invoices, audit records, executed agreements or records the responsible organisation must lawfully retain. Retention and deletion arrangements must be confirmed before this draft becomes effective.

11. Responsibility, disputes and changes

Responsibility should follow the service actually provided and the applicable contract. Nothing in the final terms should exclude obligations or rights that cannot lawfully be excluded. Liability limits and dispute procedures require legal review; no monetary liability cap is introduced by this draft.

Malaysian governing-law and dispute provisions should be confirmed by legal counsel before publication as effective terms. Any material change should be clearly dated and communicated where appropriate. Reading this draft, or signing in to view it, is not recorded as acceptance of new terms.

Items to confirm before approval

  • Confirm subscription pricing, renewal, cancellation, trials and refunds.
  • Confirm payee responsibilities and refund procedures for property payments and electricity top-ups.
  • Confirm retention, account-closure and data-export arrangements.
  • Have Malaysian counsel review liability, governing law, disputes and subscriber data-processing arrangements.
  • Approve both language versions, set an effective date, and decide how acceptance and later changes will be recorded.
